1. Personal Information Collection and Use

Our Web Site may offer public forums, including but not limited to, message boards, conversation pages, chat rooms, blogs or  profile pages (“Public Forums”). If you provide personal information through the Public Forums, that information may be publicly  posted through the Public Forums, may be used by others and otherwise disclosed without limitation as to its use by a third party.  We do not control or have responsibility for the acts of users of our Web Site. 

We also may collect information about you through a variety of methods, such as your participation in games, quizzes, contests,  blogs, forums or the like or other documents that you submit to us, transactions in which you may engage with us or our  affiliated companies, or through visits that you may make to the Web Site. This policy applies to all personal information  that we collect and maintain about our users, including any contact information (e.g., name and address), or identifying  information (e.g., date of birth) that we may obtain in connection with providing services. 2.2        Additional Information
Should a health article be published, we may also publish your first name, last initial, age and your photograph (with  posting guidelines), if you include them with your health article submissions, and display them on our Web Site. If you  activate the mobile phone options, if and when offered, under our Terms of Service and Use, we will collect your  cellular phone number and name of service provider. You will receive notifications on your cellular phone account.  If you contact us by e-mails though the Web Site, we may keep a record of your contact information and correspondence,  and may use your e-mails address, and any information that you provide to us to respond to you.

2.3       Log Data and Other Information Collected Through Technology
We collect information through technology to make our Web Site is more interesting and useful to you and for various purposes related to our business. When you visit the Web Site, our servers automatically record information that your browser sends whenever you visit a website ("Log Data"). For instance, when you come to our Web Site, we may collect information about your access time and your computer configuration, including the type of browser software you use, the operating system that you're running, the resolution of your computer monitor, the web-pages you visit, the search terms you use, any advertisements on which you click, and your Internet Protocol ("IP") address.

We use Log Data to monitor the use of the Web Site and of our services. We do not associate your IP address with  any other Personal Information to identify you personally, except in case of violation of the Terms of Service

A "cookie" is a small data file that we transfer to your computer’s hard disk. We do not use cookies to collect Personal Information. We are not responsible for the privacy of information you may submit to a linked site. If you click on a third-party link or an advertisement on our Web Site and link to a third party's Web site, then our Privacy Policy will not apply to your Personal Information collected on that third party's Web site and you must read the privacy policy posted on that site to see how your Personal Information will be handled. 2.6       Personal Profiles
Personal Profiles: When you use BodiMojo you may set up your personal profile, form relationships, send messages, perform searches and queries, form groups, set up events, add applications, and transmit information through various channels. We collect this information so that we can provide you the service and offer personalized features. Once you update your profile your previous personal information will not be saved . So certain information, such as messages and freindlists are kept in your profile unless you delete this information.  When you update information we do not keep backup copy of the prior version.

3. How Personal Information is Used
We may use your Personal Information in many ways as set out below. We may use your Personal Information to generate aggregated statistical information. But such aggregated information will exclude your Personal Information. We describe our uses of your information below. You may "opt out" of certain uses of your Personally Identifiable Information, as described in Section 4 below.

3.1 Promotional Uses
From time to time, we offer information about third-party goods and services. At that time we would also offer you the choice of  receiving that information or not, in the form of an "opt in" or "opt out." If you "opt in," we may then use your Personal Information  to send you promotional materials about third parties' goods and services (including special offers and promotions) offered by us or  our affiliates (“Promotional Uses”). These promotional materials may be sent to you by e-mail or text message. You may opt out of  receiving these communications by indicating so in your profile page as provided in Section 4 below.
When you log on to our Web Site, you may receive targeted advertisements, which means an advertisement aimed at the type of  individual who may be within a relevant audience. In this process, the advertiser never has access to Personally Identifiable Information.  This kind of advertisement targeting is done with banner ads as well as promotional e-mail on the Web Site. You will only receive special  offers via e-mail from us if you have indicated in your account preferences that you would like to receive them. You can change your  account preferences at any time.

 

Information about products or services from our Web Site, promotional materials about goods and services offered by us and/or by a third party may accompany the physical or electronic delivery of the product, service or information that you have requested. Because these promotional materials accompany products, services or information that you have requested, your opt-outs for this Web Site under Section 4 below will not apply to any of these types of Promotional Uses

3.2    Operational Uses

(We refer to all of these types of uses of your Personal information that do not involve the sending of promotional materials as "Operational Uses.") For example,  we may share personal information with our agents or service providers to send you an email on our behalf. These third parties  are authorized to use your personal information only to perform the service they are providing for us.

We do not share, sell, rent or trade Personal Information that is personally identifiable to you with third parties for their promotional purposes. Because these uses of your Personal Information do not involve sending you promotional materials and may be necessary to fulfill you account with us, your opt-outs under Section 4 below will not apply to any of these Operational Uses.

3.3    Non-Personally Identifiable Information
We may take your Personal Information and make it non-personally identifiable, either by combining it with information about other individuals (aggregating your information with information about other individuals), or by removing characteristics that make the information personally identifiable to you (de-personalizing your information). We use non-personally identifiable information in aggregate form to build higher quality, more useful services by performing statistical analyses of the collective characteristics and behavior of our users, and by measuring demographics and interests regarding specific areas of the Web Site. 3.4 Purchase or Sale of Businesses
We may purchase a business or sell our business (or portions thereof) and your Personal Information may be transferred as a  part of the purchase or sale. In the event that we purchase a business, the Personal Information received with that business  would be treated in accordance with this Privacy Policy, if it is practicable and permissible to do so. In the event that we sell  a business, we will include provisions in the selling contract requiring the purchaser to treat your Personal Information in the  same manner required by this Privacy Policy (including any amendments to this Privacy Policy). In light of this protection, your  opt-out choices under Section 4 will not affect our right to transfer your information to a purchaser in these circumstances.

3.5 Disclosures to Comply With Laws and Disclosures to Help Protect the Security and Safety of Our Web Site and Others
Regardless of any opt-out choices that you make under Section 4, we will disclose Personal Information when we believe in  good faith that such disclosures (a) facilitate compliance with laws, including, for example, compliance with a court order or subpoena; (b) will help to enforce our Terms of Service and Use; (c) protect your safety or security, including the safety and  security of property that belongs to you; (d) protect the safety and security of our Web Site, including the safety and  security of property that belongs to us; and/or (e) protect the safety and security of third parties.

4. What Choices You Have About the Collection, and Use of Your Personal Information 
You may choose to have your Personal Information not used by us in the manners described above. By default no personal information is shared with third parties unless you decide to “opt in” (a) during the registration process on our Web Site or in your privacy settings tab in your Profile. If you have decided to opt in and then change your mind there are three separate choices available to you, by which you can opt out, which appear in the following places:; (a) by logging on our Web Site, and going to a site's Privacy Setting tab in your “My Page” (sometimes called "Profile"), and following the opt-out directions (e.g., by unchecking the box that allows you to have third party notifications; (b) within an e-mail, following a link to ”Unsubscribe”; and (c) as described below in Section 6. Each of these opt-out choices is subject to the exceptions described further below in this Section 4.

Any opt-out choices you make will not apply in situations where (a) you make a specific request for information from us, (b) we use your Personal Information for "Operational Uses” (as described above in Section 3), or (c) we otherwise share your Personal Information as set out in Section 3 above. Also, any opt-out choices you make will not apply to Personal Information that you provide about other persons, but these other persons will have the opportunity to opt out of receiving promotional materials.

If you do not exercise your opt-out choices upon registration or initial log-in at our Web Site or in your profile page, it may take up to ten (10) days for your opt-out choices relating to e-mail to be fully effective and it may take up to ninety (90) days for regular mail to be fully effective. Our systems require time to update, and promotional mailings using your Personal Information shared before your opt-out may already be in process.

5. Security Measures Taken to Safeguard Your Personal Information
Your Personal Information is kept on a secure server to protect it from outside parties. We use standard, industry-wide procedures such as firewalls and encryption to protect your information. However, as effective as encryption technology is, no security system is impenetrable. We cannot guarantee the security of our database, nor can we guarantee that information you supply won't be intercepted while being transmitted to us over the Internet. From time to time, we review our security procedures in order to consider appropriate new technology and methods. Please be aware though that, despite our best efforts, no security measures are perfect or impenetrable and no software or server is 100% secure. Any information you include in a message you post to any message board, discussion group, or other public posting area on our Web Site is available to anyone with Internet access. If you don't want people to know your name or e-mail address, for example, make sure not to include it in any message you post publicly. 6. How to Correct or Update Your Contact Information and Opt-Out Choices

We cannot accept postal mail opt-out requests via telephone or facsimile, nor will we be responsible for notices that are not labeled or sent properly or lack complete information. Please note that we may require up to ten (10) days to remove electronic mailings and sixty (90) days to fully remove your postal mail information from our mailings. 
Following your opt-out, please be aware that we, or our affiliates, may continue to contact you via email or postal mail for administrative or informational purposes, including, but not limited to, follow-up messages regarding the administration of your account, any services, features or functions you have affirmatively enrolled in or registered to use, any promotions or sweepstakes you have participated in on the Web Site. Generally, you may not opt-out of these communications, which are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your account.
